The Supreme Sunday – Apex Court Creates History by Sitting on Sunday

The two-judge bench of Justice Dipak Misra and Justice A.M. Khanwilkar heard a Juhu Bungalow in Mumbai family dispute case on Sunday April 30, 2017 at 2 pm. The Supreme Court of India created history when it decided on Friday, April 28, 2017, to the disbelief of the parties and Senior Counsels, that it will sit on Sunday, April 30, 2017 at 2 pm to hear the case. Senior Advocates Kapil Sibal and P. Chidambaram for the Petitioner and Senior Advocates Shyam Diwan and Dinyar Madon for the other side could not believe that the Supreme Court had just said to hear the case on a Sunday.

There were several apprehensions towards the Sunday sitting as a senior advocate said that we need time to work while another said that the Court will have to direct the Registrar for necessary permission for them to enter. The Judge said we know it is Sunday, and we have to work. The Judge also said that if the Supreme Court can open in the night than what it is to remain open on a Sunday afternoon. The Judge then asked his brother Judge, who consented to work on Sunday, and the day or Sunday was a decided part.

Come Sunday April 30, 2017, the Supreme Court had some employees who had to report, and there was a buzz in the air on what is this case about and the hearing on Sunday. The corridor near Court Room No. 2 of the Supreme Court where the matter was to be heard, had a guard in advance. The guard said “Lagtahai koi property kamamlahai”.

The Court sat and, submissions and arguments began as parties discussed points of law and facts and, the Judges spoke about the litigations and advocacy at times. Finally, a decision was given for parties to comply with directions of the Supreme Court and one of the parties which was not present was called upon, including transfer of proceedings filed by Petitioner for its rights in a jurisdiction.

The Court proceedings were over at about 4 pm, but the experience of being in Supreme Court on a Sunday, and the commitment of Honourable Judges were commendable as they had with kindness spared their time on Sunday in the interest of justice and equity
