From Salt to Sales – A Power Packed Dialogue on The Indian Pharma Legal Aspects

THE MOLECULES IN THE MARKET – A DEEP DIVE!

There is no doubt in ascertaining that the Pharmaceuticals space has been rocketing at a lightning speed globally as far growth and innovation patterns are concerned. And the space not only limits itself to drugs, one can of course not put aside the massive medical devices, biosimilars, healthcare and the world of medicines on the internet! And as always, India leaps a very sharp and directed approach.

As per a story in Firstpost titled “Where is India’s pharma market headed? Regulatory infrastructure must be put in place to ensure global quality”, an evaluation of Rs 1.1 lakh crore (FY 2017) and a global market share of 20 percent speaks volumes about our place in the global market. The Indian pharmaceutical market (IPM) is expected to grow at 9-12 percent compound annual growth rate (CAGR) between 2016-21.

However, there is always a flip side. And here’s one that can give shivers to a General Counsel’s office.

The story further elaborates that Indian drug are failing at the World Health Organisation (WHO) quality standards and those required by the western drug regulating authorities like the Food and Drug Administration (FDA). It was not too long ago that the USFDA had found deficiencies relating to medicine quality in India. The ‘Special 301 Report’ by the United States Trade Representatives (USTR) slammed India and China as leading sources of counterfeit medicines distributed globally with 20 percent of all pharmaceutical products sold in the Indian market is estimated to be counterfeit.

These and several other aspects brought together legal and regulatory experts once again to brainstorm on the issues in hand and spear forth with a perfect compliance score in hand.
