Jalan & Company represented Berger Becker Coatings Limited before the Hon’ble National Company Law Tribunal at Ahmedabad in the matter of corporate insolvency resolution process of Essar Steel, in an application to secure the rights of Berger Becker Coatings Limited as an operational creditor of Essar Steel in light of the Resolution Plan put forth by Arcelor Mittal Group. In the arguments led by the team, an analogy was drawn from the erstwhile “Sick Industrial Companies (Special Provisions) Act, 1985 whereby the Hon’ble High Court of Delhi had permitted the creditors to opt out from the plan if the same was deemed unsuitable or unfavourable, which was also an issue in the resolution plan presented for Essar Steel.
