In a significant judgment, reported at (2016) 1 SCC 743, the Supreme Court of India struck down an order of injunction and laid down certain guidelines as to when and how an order of injunction can be passed and sustained in a suit. The suit in question involved development of 21 acres of prime residential land owned by the West Bengal Housing Board and being developed by Bengal Ambuja Housing Development Limited, a joint venture of the Housing Board and AmbujaNeotia Group (earlier a part of Gujarat Ambuja Cements). The project is valued at INR 10 Billion approximately. The Housing Board and AmbujaNeotia Group was advised and represented by S. Jalan & Company in the Supreme Court, led by MukulRohatgi, Attorney General, Jaideep Gupta, Senior Advocate for the statutory body, Dushyant Dave and Sanjiv Sen, Senior Advocates for the AmbujaNeotia Group.
