Central Electricity Regulatory Commission (CERC) has introduced a new regulations namely, CERC (Sharing of Inter-State Transmission Charges and Losses) Regulations, 2010 (“PoC Regulations”) for streamlining the collection of interstate transmission charges from various beneficiary utilities spread across India and distributing among all inter-state transmission licenses. Lanco had filed a petition before CERC to challenge the new method of computation of the transmission charges on point of connection basis. CERC has developed a completely new computation method for working out transmission charges. Trilegal has successfully demonstrated to CERC the error in some of the basic fallacies adopted by the CERC for the computation. Incidentally, CERC has amended the PoC Regulations subsequently to address some of the issues raised. The transaction was led by Sitesh Mukherjee (Partner).
