The Hon’ble Commission had held by upholding the arguments addressed by DSA that the O.P. didn’t served the hospitality services to the complainant despite being the big aviation giant during the stay of the complainant at Tehran. The Hon’ble Commission also held that there was sheer deficiency on the part of O.P. as it led to overstay of the complainant in Tehran which was due to cancellation of flight by the O.P. Further rejecting the argument of the O.P. that the tickets was purchased for commercial purpose and that’s why, the complainant is not entitled to any compensation, held that there was sheer negligence on the part of O.P as it instead of providing ticket from Tehran to Delhi provided the ticket to Mumbai which proved deficiency of services on the part of O.P. Hon’ble Commission awarded Rs 5,00000 towards Compensation and Rs 32,010/- towards value of ticket from Mumbai to Delhi to the complainant.
