The said case involves administration and enforcement of foreign works by IPRS in India on behalf of its sister societies such as ASCAP (USA), BMI (USA) and PRS (London) etc.

The learned Judge in the said judgment has upheld IPRS’s right to administer and enforce public performance rights on behalf of its sister societies in India. The learned judge has further granted a permanent injunction restraining the Defendant from organizing any live event involving literary and musical works which are held by the Plaintiff and to ensure that no copyright of the Plaintiff is infringed.

The learned Judge has further granted ` 5 lakhs as punitive damages payable within a period of four weeks and in case the said amount is not paid within the said time frame, interest of 6% per annum will be levied on the said amount from the date of the decree till the date of realization of the decree.
