Court Grants desealing on harsh penalties

In a case involving Microsoft VS EconixHitech Components, where Microsoft was represented by Anand & Anand led by its Partner, Pravin Anand, the Hon’ble Division Bench comprising of Hon’ble Mr. Justice Sanjay Kishan Kaul and Hon’ble Mr. Justice Rajiv Shakhdher passed an order on desealing of computer system using pirated software. The Bench shot down the arguments of the appellant (Econix) saying that an entity carrying out business activities using illegal software cannot be covered within the ambit of Article 19(1) (g) of the Constitution of India. “When you have been caught with your hand in the till, you cannot complain of your business coming to a standstill”, the Bench observed. The bench allowed desealing on fulfilling conditions such as depositing of sum of RS 22 lakh with the High court and a compensation of RS 75,000 to the respondent.
