The Algorithm of Success
When Pankaj Garg, won two gold medals while pursuing his LL.B in 1985 and 1986, out of his sheer desire to excel at whatever he does, little did he know, back then, that he was in effect practicing what bolsters the possibility of a success. To him dedication and passion towards profession, inter-personal skills and analytical ability are the four elements that go into the making of a good lawyer. Success or failure is the function of almighty which nobody can predict.
A lawyer with 28 Years of standing at the Bar, Mr. Garg, who also holds two Masters Degrees in Law and Economics, who has distinguished himself at Tax Litigation and Bankruptcy Laws practice is the founder and Mentor of Prakash Legal Advisers. Mr. Garg started his law practice independently from the day one and it was his sound fundamentals in law which helped him greatly in doing well. He had finished his LL.B (Professional) in 1985 and had practiced at Meerut district courts for good four years on civil side before coming to Delhi where out of sheer adventure spirit he took interest in tax practice and has been able to distinguish himself.
When asked why he chose to become Mentor of the Law colleges. Mr. Garg’s reply was unusually simple yet very profound. In his view it was of critical importance that one must strive towards mastering fundamentals of law and aim at attaining conceptual clarity with regard to that. And it is his burning desire to give it back to the profession through nurturing young legal talent into good lawyers that has led him to take up that position at the law college. He further desired that he open to give free lectures on law anywhere in the country
As already stated, to Mr .Garg, it his earnest desire to serve the profession and the community with dedicated passion. So the message, when asked, for the young lawyers was brief but effective that loyalty to the client, collegiality towards colleagues and Ethical conduct will help building a respectable practice. In his view with this ethic in mind anybody can distinguish oneself at the Bar.
Somebody who has, for greater part of his life, been a tax litigation lawyer and also practitioner of Bankruptcy laws. So asking him the question on the situation of rising NPAs in the country was only a logical progression of thought. To, that he responded, that the Govt. must bring back voluntary disclosure of income scheme (‘VDIS’) apart from striving to get the Black money back from tax havens, Hence, the need of FDI shall decrease. In his view there was already a lot of money in the economy which was lying unused and could be tapped through schemes like VDIS. He believed that there were already a lot of incentives in the economy in declaring NPAs instead of paying one’s debts which need be addressed immediately if the situation has to be brought back to normalcy. In his view the situation was not only weakening the financial system but was also leading to needless financial distress and criminal activities as well.
During the course of the interaction he shared one story wherein Mahatma Gandhi who was approached by a person against whom the allegation was that he was a smuggler. Gandhiji, the great man, asked him if he was indeed a smuggler then the better way for him would be to undergo the punishment and despite that he wanted himself to be defended then, Mahatma said he would defend him. And when the client chose the second option, Mahatma got him exonerated of the charge. As per Mr. Garg herein lay Gandhiji’s Talisman for ethical conduct which every lawyer must follow.
An ardent follower of Srimad Bhagvad Gita and a practitioner of its principles in life, remaining true to his credo that, passion and dedication are the true mantras for success. He shared his work, which is still in progress, wherein Mr. Garg has traced the principles of jurisprudence back to Bhagvad Gita. In his view the holy book was the source of all jurisprudence and that will stand established when his work will be published.
