Khaitan& Co. represented Monotona, the respondent Company in two company petitions filed against Monotona for winding up by Gayatr iRubchem Private Limited and Gayatri Elastomers Private Limited on the grounds that Monotona have been unable to pay debts amounting to Rs 6,27,22,902 and hence under section 433 and 434 of the Companies Act, 1956, the company should be wound up.

Khaitan & Co successfully defended both the company petitions and the Hon’ble Bombay High Court was pleased to dismiss both the Company Petitions and costs were imposed on the Petitioner Companies.

Monotona is a part of RUIA GROUP having Dunlop India Ltd and Falcon Tyres Ltd within the group and is engaged in the manufacturing sector.
