On 28 January 2016, the English Court will be considering whether it has jurisdiction to determine a US$ 70 million claim brought by Erdenet Mining Corporation of Mongolia, represented by Zaiwalla & Co. LLP, against the Government of Kazakhstan, represented by Reed Smith. The issue to be decided by the court is, cam an agreement between the parties to submit the dispute to an International Judicial Body, be construed as an agreement conferring jurisdiction on the English Courts, on the basis that the English Commercial Court is internationally recognised by its reputation as an International court for deciding commercial disputes between foreign parties.
