Zaiwalla & Co Solicitors Consults on Russian Federation’s Success in the Dutch Court to set aside the Yukos Award for USD 50 billion

Zaiwalla & Co is very pleased that the Dutch Court has delivered a judgment setting aside The Hague Arbitration Tribunal’s Yukos Award against the Russian Federation of Euro 50 billion. Between July and October 2014, after publication of the award, Zaiwalla & Co was consulted on behalf of the government of the Russian Federation to advise on an ‘out of box’ approach which the Russian legal team could take in the Dutch Court to challenge the Award. The award was set aside on the ground that the Energy Charter Treaty, under which the Arbitration Tribunal was appointed, was not valid because the Treaty was not approved by Russian Parliament under the provisions of the 1993 Russian Constitution.
