Khaitan & Co. successfully advised Indian Jute Mills Association

Khaitan & Co. successfully advised Indian Jute Mills Association (IJMA) in relation to a Competition Commission of India (CCI) decision wherein the CCI had imposed a penalty amounting to INR 7.68 lakhs upon IJMA, for allegedly cartelizing with the Gunny Traders Association to fix prices and control the production of jute bags.

Additionally, 25 office bearers of IJMA were also penalised on account of their being in-charge of/responsible for the conduct of IJMA during the period of investigation. We filed an appeal against the CCI’s Order, on behalf of IJMA and its certain office bearers, before the Competition Appellate Tribunal (COMPAT) on a number of grounds on merits. Based on our arguments, the COMPAT issued a decision allowing the appeals of IJMA and setting aside the CCI’s order.

Firm represented IJMA and its certain office bearers before the CCI and COMPAT. This matter was one of the few cases wherein the COMPAT overturned the CCI’s Order on substantive issues.
