S.Jalan & Company, Kolkata represented Simplex Infrastructures Limited in an action under Section 8 of the Insolvency & Bankruptcy Code, 2016 filed against the company in NCLT, Kolkata Bench. The Bench of Justice K.R. Jinan, Hon’ble Judicial Member while rejecting the application filed by the alleged creditor upheld the contention of Simplex Infrastructures Limited that there was a pre-existing dispute regarding the claim and the claim, if any, was also barred by limitation.
